What is a malt beverage manufacturer, bottler, or wholesaler?

Malt beverage manufacturer means any manufacturer, brewer, importer, or master distributor of malt beverages. A bottling company is one whose output is the physical bottling of beverages for distribution. A wholesaler is the holder of a malt beverages wholesaler permit that sells the malt beverage.

Why do I need a beverage wholesaler bond in Virginia?

The Virginia Department of Alcoholic Beverage Control requires malt beverage manufacturers, bottlers, and wholesalers to post surety bonds in amounts based on the volume of business conducted by the applicant.

Virginia malt beverage manufacturer, bottler, and wholesaler bonds ensure principals (manufacturers, bottlers, and wholesalers) file reports showing the quantity of all beer and beverages manufactured, bottled, or sold during the preceding calendar month and the amount of tax, if any, for which the principal is liable with the board on or before the 10th day of each month.

The bond also ensures that the principal pays all excise taxes due to the board as required by the provisions of Chapter 4.1 of Title 4.1 of the Code of Virginia.

If the principal fails to comply with these terms, the bond protects the state from financial loss up to the full amount of the bond.

Additional details on malt beverage bonds in Virginia

Malt beverage manufacturer, bottler, and wholesaler bonds in Virginia remain in full force and effect until canceled or violated by the principal. The surety can cancel the bond by giving written notice of cancellation to the board at least 30 days prior to the effective termination date.

This bond requires both the applicant and surety’s signature to be acknowledged by a notary public.

How to get a malt beverage manufacturer, bottler, or wholesaler license

To get licensed as a manufacturer, bottler or wholesaler, the Virginia Alcoholic Beverage Control Authority requires different applications and permits depending on the types of business operations.

All license types fall into three basic categories: banquetretail, and industry.

To ensure you apply for the correct license type, read through the details and descriptions of each category. You should also check to see if you will need an additional permit for your business, which is common for special circumstances and instances that may combine certain retail and industry licenses.
