What Is a Florida Hazardous Waste Facility Bond?

A Florida hazardous waste facility bond ensures that facility operators comply with the terms of Section 3004 of the Resource Conservation and Recovery Act of 1976, the rules and regulations of the EPA, and the rules and regulations of the Florida Department of Environmental Protection, particularly Chapter 62-730 of the Florida Administrative Code.

This bond is required for statewide licensing for all Florida companies involved in hazardous waste treatment, storage or disposal.

How Does It Work?

If you fail to comply with the bond terms, the surety reimburses claims from any third party who suffers from bodily injury or property damage that occurs as a result.

The surety can cancel this bond by sending 120-days written notice of cancellation via certified mail to both the principal and FDEP Secretary.
