What is a Florida private educational institution bond?

Florida Statute 1002.421 (f) requires that each private school participating in an educational scholarship program file a bond if they have not been in operation for at least 3 school years. The state's official bond form is titled the “Private Educational Institution Bond” but is also known as the “private school bond.” The bond amount required varies by school but must be equal to the scholarship funds for any quarter.

Why do private schools need this bond?

By filing this Florida surety bond, private educational institutions agree to operate according to Florida Statutes, the Florida K-20 Education Code, and all rules and regulations enforced by the Department of Education. If a private school fails to do so, their issuing surety company will pay valid claims up to the full bond amount, which the institution must reimburse.

Who regulates licensing for private education institutions?

The Florida Department of Education does not enforce any licensing, accreditation, or regulations for the state's private education institutions. If you have questions about managing your private school, you can contact the Florida School Choice Office of Independent Education and Parental Choice by calling 1(800)447-1636 or by filling out the contact form. Florida statutes do require private schools to complete an annual online survey for the public statewide Directory of Private Schools.

Who benefits from a private school surety bond?

This Florida private educational institution bond specifically benefits the state and students if a private school commits fraud or otherwise fails to comply with Florida statutes, the Florida K-20 Education Code, or other Department of Education rules and regulations. Any claims paid by the issuing surety company must be reimbursed by the private school.

How do I update or change my Florida private school bond form?

If the Office of Independent Education and Parental Choice requires your bond to be updated for any reason, contact your surety company. If you purchased your bond from SuretyBonds.com, email [email protected] to explain the needed change. The most common changes for these bonds include updating your school's name or address.

How do I renew my private education institution bond?

You must renew your Florida private education institution bond before its current term expires. Once you pay your SuretyBonds.com renewal invoice, renewal instructions will be sent to keep your private school surety bond active.

How do I get my private education institution licensed in Florida?

Florida does not require private schools or private education institutions to be licensed. You do not need to submit application paperwork for licensing.
