Why do I need this bond?

The Division of Consumer Protection, within the Utah Department of Commerce, requires a $50,000 surety bond under Section 13-49-201 of the Immigration Consultant Registration Act.

This bond protects any individual or group of individuals who is harmed as a result of the principal’s (immigration consultant’s) unlawful business practices. The surety will cover damages up to the full sum of the bond, and the principal must reimburse the surety for all damages paid out. Prohibited actions as an immigration consultant include, but are not limited to:

  • Making a false or misleading statement to a client while providing them services
  • Making a guarantee or promise to the client unless it is in writing and based on some fact
  • Charging a client a fee for referral of the client to another person for services that the immigration consultant cannot or will not provide to the client

What’s the fine print?

Utah Immigration Consultant bonds are written for one-year terms and remain in full effect unless there is a claim against them or they are canceled. The surety has the right to cancel a bond, by giving the obligee at least 90 days notice before the effective date.

  • a nonrefundable $200 registration fee
